TERMS AND CONDITIONS OF SALE

These General Terms and Conditions of Sale are sent to the Customer at the same time as the quotation to enable him to make his reservation. Any reservation therefore implies the customer’s full and unreserved acceptance of these conditions. Reservations and/or orders for services are reserved for customers who have read and understood the present terms and conditions of sale in their entirety, and who have accepted them without reservation. Consequently, placing an order implies full acceptance of these terms and conditions of sale, and unreserved acceptance of all their provisions. In the interest of customer satisfaction, the Société Prestataire may change these terms and conditions, as well as its product ranges.

Services : The Service Provider undertakes to carry out the service as described in the quotation. Nevertheless, certain dishes or beverages may be unavailable from time to time, and the Customer will be informed immediately, in which case an alternative will be proposed. Any reduction by the Customer in the number of guests less than 3 working days before the date of the event will result in invoicing on the basis of the validated quote.

Changing the number of guests up to three days before the date of the event : If the number of cancelled guests represents less than 20% of the total number of guests, the Customer will not be invoiced for the absent guests. If more than 20% of the total number of guests is cancelled, the Customer will be invoiced for the absent guests. For any modification 3 days or less before the date of the service, whatever the number of participants cancelled or not present on the day of the service, the cancellation fee will be 100% of the unit price shown in the initial quote, multiplied by the number of participants cancelled.

Reservations – Payment: The reservation of a service is firm and definitive only after acceptance, signature of the quotation and payment of the deposit corresponding to 50% of the total amount of the quotation. The balance must be paid by the customer no later than the day of the event.

Cancellation policy: In the event of cancellation of the reservation by the customer, the following amounts will be cashed:

For a total cancellation less than one month and more than three weeks before the event: If the Customer decides to cancel the entire event between three weeks and one month before the scheduled date, the Customer will be invoiced and liable for 50% of the total amount including VAT confirmed in the quote.

For a total cancellation less than three weeks and more than two weeks before the event: If the Customer decides to cancel the entire event less than 2 weeks before the scheduled date, the Customer will be billed and liable for 80% of the total amount including VAT confirmed in the quote.

For a total cancellation within two weeks of the event: If the Customer decides to cancel the entire event less than 2 weeks before the scheduled date, the Customer will be invoiced and liable for 100% of the total amount including VAT confirmed in the quote.

Force majeure: In the event that a force majeure event prevents the event from taking place, the Parties undertake to meet and discuss in good faith in order to find an alternative solution.

Liability: Failure to return equipment or damage in any form whatsoever to the premises or equipment made available to the Customer by La Société Prestataire will systematically result in a charge equivalent to the purchase or repair value. The Customer will be held responsible for any damage caused by his guests, his proposed guests or himself. In all cases, the amount of the Provider’s liability is limited to the amount of the sums paid by the Customer.

Jurisdiction: Any dispute relating to the interpretation and execution of these general terms and conditions of sale is subject to French law. Failing amicable resolution, which must be attempted by the parties, the dispute will be referred to the Commercial Court of Paris.
